The "victim" has broadcast their footage publically and without a copyright claim. Intellectual property and copyright law is not my specialty, but it's not a crime to record a public broadcast and I doubt it opens you up to civil liability either.
However...
If you distribute that recorded sex cam, you would likely open yourself up to criminal charges under stalking legislation. If you repeatedly publish on the internet or via email or any other electronic means any material relating to the victim, and you either intended or should have known that your actions would cause physical or mental harm to the victim, then you could be charged with an offence punishable by up to 10 years in prison.
So recording a cam to whack off to later is not a problem. But sending that recording to the performer's family and workmates could get you in a lot of trouble.

We are very open about what we do, but still would not like someone to record us without our permission, would love them to do it with our permission.
The problem isn't so much that someone is being recorded, it is that someone IS recording.
For those continually using the "you know the dangers" bullshit excuse, that is not on.
We joined this site to meet with swingers, for those that do not know that term look it up.
If someone wants to record wouldn't it be easier to ask, without the ramifications.

I love AJ's idea of the disallow option, stop certain fuckwits watching, they can comment all they want.
But I think we are missing the point completely, there needs to be a bit more of a screening of members who sign up, especially now that is becoming larger and more members(remember more members is "good", more fun friends), but without appropriate screening = more dodgies.

You don't have to actually claim copyright when you produce something that is an original you own the copyright just as long as you are the one to broadcast it first and you have proof of that fact..

It's not really a PUBLIC broadcast, one must be a member before they can see it. So therefore not a public broadcast, but an illegal and fucked recording and distribution

...andon the subject of the tread - It's VERY possible for a block button to be coded into the web site (despite what any mods might tell you). It's just up to the owners of web sites whether they tell the coders to put it there or not.
EVERYTHING about web sites is determined by the strokes of the keys that put things there.
We'll just have to wait & see if people power prevails, and the owners wish to look after the clients they currently have, or go looking for new ones when people leave in frustration. We're a fickle bunch. If something new comes along, we flock to it.

Video and audio are taken of all of us every day but every one from business, government dept and even just someone recording you to put on youtube for what ever reason, so i cant see how your explaination works. im not arguing for sake of it, im just sick of seeing ppl post legal comments on this site without actually knowing the law and then others like myself thinking we might be covered. Just by knowing your cam can be recorded before you broadcast doesnt that show prior knowledge. Just for record too i think that it is wrong to do but not much anyone here can do

i understand there is currently a block button available , how ever , never having used it i don't fully understand what it does , but from what i gather from reading this thread ,,it blocks completly anyone you choose , for whatever reason , from seeing your profile and also you from seeing anything they may write or message you ,,,am i right ??? my question here is twofold ,,,firstly is it a permanant block or does it need to be put into place each time the blocker logs on ?? secondly ,,as you have already chosen to block someone ,why does it not also block your cam already ,,after all you have already made a choice to prevent someone from interacting with you ,,,,i would have thought ,honestly that this would be the case and am somewhat surprised that this is not

I don't think an argument about points of law is that interesting nor is going to resolve the underlying issues. Unfortunately even with opt in or opt out buttons/options we all run the risk of our images being taken and displayed in situations which we may find uncomfortable as people who we may have considered low risk may not take rejection too well. While I hope I have never been pushy on the site, I have chatted to some guys out there who don't seem to take no for an answer. It's like dealing with a five year old - if I ask the same question a different way maybe I'll get what I want!! I take pity for the lovely lasses who are on the site who would cope it far worse than me.
I would like to be more open but realise there are always that minority out there who will spoil it for the rest. This is the reason I don't openly display my photos but am happy to share with anyone who asks to see them. Maybe they could implement a better sharing system depending on a person's SHEP rating or the like. I'm not sure if this will work or is a great idea as those starting out may struggle to see anything!
I don't know what the answer is but until then i think we should still continue to support each other and have fun! After all you only live once.

You are talking about two different types of recording
Government agencies have either warrents or exclusion clauses in the relevant acts
Other places like a shop or other business notify you by signage, therfore you are made aware.
These places do not distribute these recordings unless it is part of their purpose and if displayed publicly usually have identifying marks removed or blurred. ( ie traffic cam footage on aca with blurred number plates)
Going on a website and recording a broadcast is not permitted.
Try going on or , record a broadcast, and if you get caught watch the shit fly.
If you are in the same legal jurisdiction as the performer you better keep an eye out for the boys in blue.
You are right in saying it can/does happen, you are wrong in saying that it is legal or that there are no repercussions for offenders. It is just hard to police.
2bnorti if you or your friend can get a copy of the file you may take to the police computer crime squad. Its digital "finger" print may lead to the perpetrators. It wont be high on their list of priorities and the general duties officer's may say it your own fault but it is a matter to be looked into if thats whst you wish.

lonelydad... The only block function available on this site (that I'm aware of) is the one that stops people from being able to whisper you in the chat rooms.
When I mentioned the other (much more functional) block feature, I was talking about another swinger related site that many of us migrated from, to come to this one.

Having said that, it defy's reason that the site does not allow the same feature for cam protection.
Clearly copying of pics has been a problem as the profile pics now have the members name over the image.
This stops all but the underhanded computer genius from screen shot an image and keeping it .
I think the underlying problem is the site try's to be everything to everyone when the various groups , fetishes, regions whatever have opposing agenda's.
A couple demanding discretion and a comfortable relationship, obviously have an entirely different set of parameters and balances to a guy who wants dogging so there's no personal knowledge or association or further contact .
The completing situations are to vast to accommodate under one heading and in time the site may need to rationalise its membership so members get more " like minded people" without the need to block and fend off totally unsuitable people to the stated profile preferences.
We believe the types of members not genuine swinging couples may actually do better on a site designed and populated by like minded people. Rather than spend a lot of time engaged in something with very low success rates when a majority of active and participating members totally exclude another member type.
This could be the cause of frustration and fuck the rules or common decency type of attitudes these floundering members experience when they turn on the rest of us.

Within the bounds of the rules here, naming and shaming is not allowed, If I can please ask anyone who is being abused to copy and paste the conversation to a moderator ... Its not something we tolerate .. and as a mod here I want to be able to make sure everyone has the right not to be abused by anyone ..... No means No ... no one should assume they are allowed to be abusive of any member ...if we are not here, there is a report button on every profile on site ..
